These Terms of Service (the "Terms") set out the conditions for using the website "nebulacore-ark.com" operated by NebulaCore ARK (also known in Japanese as 星雲; "we" or "us"), the shared sign-in feature we provide ("NebulaCore ARK account"), and the "E ARK-apps" series (Anonify, Astro Arch, WordOrbit, Union and Sirius), together the "Services". By using the Services you ("User") agree to these Terms. This is an English translation of the Japanese Terms of Service. If the two differ, the Japanese version prevails.
Article 1 (Scope)
- These Terms apply to all matters relating to a User's use of the Services.
- If an individual app's screen or description page contains separate notes or rules, they form part of these Terms. If they conflict with these Terms, the app's own notes or rules prevail.
- The handling of personal information is as set out in the Privacy Policy.
Article 2 (Fees)
- The Services are currently free of charge.
- If we make all or part of the Services paid in the future, we will announce it on the Site in advance. No fee will be charged without your agreement.
- Communication costs and other costs needed to use the Services are borne by the User.
Article 3 (NebulaCore ARK account)
- Using WordOrbit requires signing in with a NebulaCore ARK account. The other apps can be used without registration.
- Your identity is verified with a one-time link sent to your email address, or with your Google account. No password is set.
- Users are responsible for managing their own email and Google accounts. We are not liable for damage caused by poor management of devices or email accounts, or by use by a third party, except where we have acted intentionally or with gross negligence.
- Each person may hold one account, and accounts may not be transferred or lent to others.
- For operational reasons, we may make registration subject to approval or limit who can register.
- You can withdraw at any time from the account settings page. When you withdraw, personal information such as your email address is deleted or anonymized in accordance with the Privacy Policy.
Article 4 (Usage limits)
- To keep the Services stable and prevent misuse, we may set limits for each app, such as the number of uses per day or the amount of input per use.
- For WordOrbit, as of the date of these Terms, the limit is five uses per account per day and 1,000 characters per use. Reading text from an image counts toward the same limit.
- We may change these limits at any time without notice.
- Creating multiple accounts to get around the limits is prohibited.
Article 5 (Prohibited conduct)
Users must not do any of the following when using the Services.
- Act in violation of law or public order and morals.
- Infringe the copyright, portrait rights, privacy or other rights or interests of a third party.
- Use the Services to slander others, impersonate others, or create malicious deepfakes.
- Enter or send another person's personal information, confidential information, or information that may infringe another person's rights to the Services without authority.
- Place an excessive load on our servers or networks, or interfere with or damage their functions.
- Use automated programs to use the Services in large volume or continuously (unless we have permitted it).
- Attempt unauthorized access, probe for vulnerabilities, bypass authentication, or get around usage limits.
- Resell or re-provide the Services to third parties without our permission.
- Make false reports to us or to third parties, or engage in any other conduct we judge inappropriate.
Article 6 (Input data and results)
- Rights in the text and images that Users enter or upload ("Input Data") belong to the User or the rightful owner. We process Input Data only to the extent needed to provide the Services.
- How each app handles Input Data (such as discarding it after processing, and whether it is sent to external services) is as set out in the Privacy Policy.
- To proofread, WordOrbit sends the text or images you enter to external AI and character-recognition services (paid services provided by Google). Under Google's terms, this content is not used to train Google's AI or to improve its products. We also do not store what you enter or use it to train AI. However, please do not enter personal information or confidential information.
- Images processed or generated with the Services and proofreading results may be used for personal or commercial purposes. This assumes that the User holds the necessary rights in the original Input Data.
Article 7 (Accuracy of results)
- We do not guarantee that proofreading suggestions from WordOrbit, building-code calculation results from Astro Arch, image enhancement by Sirius, or any other result is complete, accurate, or fit for a particular purpose.
- Astro Arch results are provided as a reference for design and applications and do not guarantee compliance with the Building Standards Act or any other law. For actual design, applications and construction, always check the relevant laws, ordinances and the practices of the administrative authority, and make the final decision at your own responsibility.
- Saving and managing results, and the consequences of using them, are the User's own responsibility.
Article 8 (Intellectual property)
Rights in the programs, design, text, logos and other elements of the Services belong to us or to third parties who rightfully hold them. Permission to use the Services under these Terms does not transfer or license any of those rights.
Article 9 (Advertising)
To cover the running costs of the Services, we may show third-party advertising such as Google AdSense on the Site and in the Services. How information related to advertising is handled is as set out in the Privacy Policy.
Article 10 (Suspension of use or accounts)
- If we judge that a User has violated or may violate these Terms, we may restrict that User's use of all or part of the Services, or suspend their NebulaCore ARK account, without prior notice.
- We are not liable for damage to the User caused by the measures in the preceding paragraph, except where we have acted intentionally or with gross negligence.
Article 11 (Changes, interruption and end of the Services)
- We may change the Services, or interrupt or end them, without prior notice to Users. Experimental features in particular may be changed or ended without notice.
- The Services may be temporarily unavailable because of maintenance, system failure, natural disaster, or the outage of an external service.
- We are not liable for damage to Users caused by a change to, interruption of, or end of the Services, except where we have acted intentionally or with gross negligence.
Article 12 (Disclaimer)
- The Services are provided "as is". We do not guarantee that the Services are free of factual or legal defects (including defects in safety, reliability, accuracy, completeness, effectiveness or fitness for a particular purpose, security flaws, errors or bugs, and infringement of rights).
- Except where we have acted intentionally or with gross negligence, we are not liable for damage to a User arising from use of, or inability to use, the Services.
- Notwithstanding the preceding paragraph, if the contract with a User is a consumer contract under Japan's Consumer Contract Act and damage to the User arises from our default or tort, we are liable to the extent provided by law.
- Where the Services link to external websites, we are not responsible for the content of those sites.
- Disputes between a User and a third party are to be resolved by the User at their own responsibility.
Article 13 (Changes to these Terms)
- We may change these Terms when we judge it necessary, in response to changes in law or in the Services.
- Revised Terms take effect when posted on the Site. If a change significantly affects Users, we will announce it on the Site.
- A User who uses the Services after a change is deemed to have agreed to the revised Terms.
Article 14 (Governing law and jurisdiction)
- These Terms are governed by the laws of Japan.
- For any dispute relating to the Services, the court of first instance shall be a court in Japan that has jurisdiction under the Code of Civil Procedure.
